Bramscher Str. 14

1. Arrival / Check-In / Departure

Check-in is available from 3:00 p.m. until 4:00 a.m. the following day. Departure must take place no later than 11:00 a.m. on the day of departure. Exceeding the departure time by more than 30 minutes will result in the charge of an additional overnight stay. Other arrival and departure times may be individually agreed with the landlord.

If the renter does not arrive by 12:00 midnight on the day of arrival, the contract shall be deemed terminated after a period of 48 hours without notification to the landlord. The landlord or their representative may then freely dispose of the property.

As a general rule, no full or partial refund of the rental price will be made in the event of an early departure.

2. Special Requests

Special requests and additional agreements are generally possible. They require written confirmation by the landlord.

3. Payment

The rental agreement becomes valid upon receipt of payment into the landlord's account. Failure to make payment shall be considered a withdrawal and entitles the landlord to re-let the accommodation.

No additional charges are levied for water or waste disposal. Energy costs will only be charged in the event of unusually high consumption.

4. Cancellation

You may withdraw from the contract at any time. The cancellation must be made in writing.

  • If you cancel between the day of booking and 14 days before the start of the rental period (check-in at 3:00 p.m. on the day of arrival), the guest will receive a refund of 100% of the total price.
  • If you cancel between 14 days and 3 days before the start of the rental period (check-in at 3:00 p.m. on the day of arrival), the guest will receive a refund of 50% of the total price.
  • If you cancel less than 48 hours before check-in (3:00 p.m.), the full travel price must be paid.

The date on which your cancellation notice is received shall apply in each case. Any amounts already paid will be taken into account. Subject to prior agreement, you may provide a replacement person who enters into your contract under the stated conditions.

5. Obligations of the Renter

The renter undertakes to treat the rented property (accommodation, inventory and outdoor areas) with care. If damage to the accommodation and/or its inventory occurs during the rental period, the renter is obliged to notify the landlord immediately.

Any defects or damage already identified upon arrival must be reported to the landlord immediately; otherwise, the renter shall be held liable for such damage. A reasonable period must be allowed for the rectification of damage and defects.

Claims arising from complaints that are not reported immediately on site are excluded. Complaints received by the landlord only at the end of the stay or after leaving the holiday accommodation are likewise excluded from claims for compensation.

In the event of any disruption to services, the renter is obliged, within the scope of their legal obligations, to do everything reasonably possible to assist in remedying the disruption and to keep any resulting damage to a minimum.

On the day of departure, the renter must remove all personal belongings, household waste must be disposed of in the designated containers, and dishes must be clean, washed and stored in the kitchen cupboards.

6. Failure to Comply with the House Rules

The host reserves the right to terminate the contractual relationship without notice and without refund in the event of violations of the house rules or accepted standards of conduct (such as noise, unauthorized visitors or smoking in the apartment).

7. Smoking Is Not Permitted

Smoking in the apartments is strictly prohibited. In the event of non-compliance, a flat cleaning fee of €250 will be charged.

8. Dogs

8.1 Dogs are permitted in certain accommodations. The renter is obliged to check the availability of pet-friendly accommodation before booking. Dogs may be brought into pet-friendly accommodation subject to the following conditions:

  1. Dogs are not permitted on the bed, couch, sofa or other sleeping or seating furniture in the accommodation.
  2. The renter is responsible for ensuring that their dog does not cause any damage to the accommodation or its inventory.
  3. The dog must be supervised at all times in order to avoid disturbances or inconvenience to other renters or neighbours.
  4. All waste left by the dog must be removed promptly and properly by the renter.
  5. The renter is liable for all damage caused by the dog.
  6. The dog owner is required to have valid liability insurance for the dog and to provide proof of insurance to the landlord upon request.

8.2 In the event of non-compliance with the above provisions, the landlord reserves the right to charge a special cleaning fee of €250. This fee is intended to cover the additional cleaning costs resulting from the presence of the dog and failure to comply with the rules.

8.3 The landlord reserves the right to refuse dogs in certain accommodations without stating a reason.

8.4 The guest assumes full responsibility for any damage caused by the guest or their dog to the accommodation or its inventory.

8.5 The landlord is not liable for injuries or damage suffered by the guest or accompanying persons as a result of the dog or other animals during the stay.

8.6 The guest agrees to indemnify the landlord against any claims or demands that may arise in connection with bringing their dog.

9. Electric Cars

Charging a vehicle using household electricity through a standard electrical socket is prohibited.

10. Liability

The property description has been prepared to the best of our knowledge. No liability is accepted for any impact on the rental property caused by force majeure, locally customary power or water outages, or severe weather.

Likewise, no liability is accepted for unforeseen or unavoidable circumstances such as official orders, pandemics, sudden construction work, or disruptions caused by natural or local conditions. However, the landlord will be happy to assist in resolving such problems where possible.

Liability on the part of the landlord for the use of the provided recreational and sports equipment and other equipment (such as a toaster, charging station, kettle or stove) is excluded.

The renter's arrival and departure are undertaken at their own responsibility and risk. The landlord is not liable for personal belongings in the event of theft, water damage or fire. The renter is fully liable for deliberate destruction or damage.

11. Final Provisions

Photos and text on the website or in the flyer are intended to provide a realistic description. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g. furniture), provided that they are of equivalent quality.

Should one or more provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic and legal intent of the contracting parties.

German law applies. The place of jurisdiction and place of performance is Osnabrück.
